USA Duty update

You will have seen the stories in the news about the changes in U.S. tariffs, we have detailed below what has formally confirmed as of now.

A short recap:
 

  • (20th Feb 2026) The U.S. Supreme Court has ruled 6–3 that IEEPA does not authorise the President to impose tariffs, removing the legal foundation for the recent IEEPA tariff regime.

  • Within hours, the White House responded with a new measure under Section 122.

Here is what’s confirmed:
 

  • IEEPA tariffs ruled unlawful - the 170-page ruling does not include detail on refunds or repayment mechanisms. IEEPA tariffs will stop being collected from the 24th February.

  • A 10% global tariff under Section 122 applies from 24th February 2026 for up to 150 days (until 24th July 2026).

  • Section 122 stacks on top of MFN base rates and Section 301, but does not stack on Section 232.

  • Postal shipments will also face the 10% Section 122 duty from 24th February. The Qualified Party process continues.

  • There is still no mechanism in postal to collect MFN, Section 301 or Section 232. EO language confirms a new postal entry process is being actively developed.

  • President Trump has publicly indicated the rate will increase to 15%, the statutory maximum. No EO or CSMS has formally confirmed this at the time of writing, but it is expected.

In short this means that you will be paying 10% duty tariffs for Goods sent into the US as of today, noting this is subject to change. The situation remains fluid and we will update you further as and when we received formal confirmation of any further changes.
